Final reminder via Registered Email ™
If you have an email address of your customer/debtor, the final reminder (in addition to our usual letter) will be sent free of charge via Registered Email ™. The Registered Email ™ has the same legal status as sending a registered letter. In doing so, it gives the warning more power and often results in faster payment.
Legal requirements collection process
As of 1 July 2012, the Wet Incassokosten (WIK) (Dutch debt collection Act) came into effect. This means you are obliged to send consumers (private debtors) a final reminder (14-days-letter) first.
We ensure that the final reminder meets the 2 legal requirements:
- Indication of a payment deadline of 14 days
- Indicate the exact amount (collection costs) that will be charged after the 14 days have passed
Has the debtor still not transferred the outstanding amount? Then let us start the collection process. We then give your debtor a notice of default for the invoice amount including the statutory interest and collection costs. If that doesn’t work, then we can carry out a house visit, credit check or, worst case scenario, start legal proceedings.
